Terms of Use

These Terms of Use ("Terms") govern your use of RUNGEON: Roguelite RPG ("RUNGEON", "the Game", "we", "us" or "our"), developed and published by Javier Hernández Torres.

By downloading, installing, accessing, or using RUNGEON, you agree to these Terms. If you do not agree with these Terms, you should not use the Game.

2. License to Use the Game

Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use RUNGEON for your personal, non-commercial entertainment purposes.

You do not acquire ownership of the Game or any of its content.

3. Intellectual Property

RUNGEON, including its name, logo, artwork, graphics, characters, audio, music, software, code, design, text, game mechanics as applicable, and other content, is owned by or licensed to Javier Hernández Torres and is protected by applicable intellectual property laws.

Except where expressly permitted by law or by us in writing, you may not copy, reproduce, distribute, modify, adapt, publicly display, publicly perform, sell, license, or otherwise exploit any part of the Game.

5. Game Progress and Local Data

RUNGEON does not operate a user account system or a server-side database for player progression.

Gameplay progress and other game information may therefore be stored locally on your device.

You acknowledge that local game data may be lost as a result of uninstalling the Game, clearing application data, changing devices, operating-system actions, device failure, or other circumstances outside our control.

We do not guarantee that locally stored game progress will always be preserved.

6. Google Play Games and Apple Game Center

RUNGEON may integrate Google Play Games Services on Android and Apple Game Center on iOS to provide achievements and related platform functionality.

Your use of those services is also subject to the applicable terms and policies of Google or Apple.

7. Advertising

RUNGEON may display advertisements provided by Google AdMob.

These advertisements may include interstitial advertisements and optional rewarded advertisements.

Rewarded advertisements are optional. If you choose to watch a rewarded advertisement, the Game may provide the in-game reward described at the time the advertisement is offered.

Advertising and consent practices are described in our Privacy Policy.

8. Remove Ads

RUNGEON offers a one-time, non-consumable in-app purchase called "Remove Ads".

When successfully purchased and recognized by the applicable platform, Remove Ads disables the interstitial advertisements covered by the product.

Purchases are processed by Google Play or the Apple App Store. We do not process or store your payment card details or other payment credentials.

Purchase availability, billing, payment processing, refunds, and certain purchase-related matters are governed by the applicable platform's terms and policies.

9. Updates and Changes

We may update, modify, improve, suspend, or discontinue parts of RUNGEON at any time.

This may include changes to gameplay mechanics, content, balancing, features, compatibility, advertisements, or supported devices.

We are not obligated to maintain any particular feature or version of the Game indefinitely.

10. Availability

We aim to keep RUNGEON available and functional, but we do not guarantee that the Game will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.

Access to third-party services such as Google Play Games, Apple Game Center, Google AdMob, Google Play, or the Apple App Store may depend on those third parties and may be unavailable or changed independently of us.

11. Disclaimer

To the maximum extent permitted by applicable law, RUNGEON is provided on an "as is" and "as available" basis, without warranties of any kind except where warranties cannot legally be excluded.

We do not guarantee that the Game will meet your particular requirements, operate without interruption, or remain available indefinitely.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Javier Hernández Torres shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of RUNGEON.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including mandatory consumer rights.

13. Consumer Rights

Nothing in these Terms is intended to limit any mandatory rights or protections you may have under applicable consumer protection laws.

If you are a consumer in the European Union or another jurisdiction providing mandatory consumer protections, those rights remain unaffected by these Terms.

14. Termination

You may stop using RUNGEON at any time by uninstalling the Game.

We may terminate or restrict your license to use RUNGEON if you materially violate these Terms or applicable law.

Provisions concerning intellectual property, disclaimers, limitations of liability, and other provisions that by their nature should survive termination will continue to apply.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page with a revised "Last updated" date.

Your continued use of RUNGEON after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

16. Governing Law

These Terms are governed by the laws of Spain, without prejudice to any mandatory consumer protection provisions that may apply in the country where you reside.

Where permitted by applicable law, disputes arising from or relating to these Terms or RUNGEON shall be subject to the competent courts of Spain.
